TrustCloud Beta: Terms of Service

Who we are

TrustCloud is a New York based company that measures the trustworthiness of persons based on their online and offline actions. We do this by applying our proprietary algorithms across three basic layers of data sets (existential, behavioral and transactional) and analyzing many elements within each layer. We acquire this data from various sources on behalf of TrustCloud users and with their consent and enhance it based on our formulas. We consider this to be data we own, together with the underlying users we serve.

We offer the TrustCloud TrustCard Widget to TrustCloud Beta participants, which renders a TrustCard with a score and badges to users of your site.

We also offer the TrustCloud API, where Partners can use our data to enhance their site's existing trust and safety solutions. These custom API integrations are designed to work seamlessly with your site.

Our goal is to help you increase trust and manage risk on your peer marketplace.

What we will do

The easiest, quickest option is for TrustCloud to provide You a widget for use on Your site during TrustCloud's Beta program, where Your users can display their TrustCards. A second option is we can provide an API as an ingredient in Your site's Trust solution. In either case, we feel the power of networked data in peer to peer transactions will be more powerful than any single solution.

What you may do

In order to give you access to our services during our Beta program, TrustCloud grants to you a non-exclusive, non-transferable, non-sublicensable license to use and access the API and data provided by TrustCloud in connection with our Beta program. You may not reproduce, modify or reverse engineer any of the data, products or services provided to you by TrustCloud, or otherwise attempt to discover any source code or underlying proprietary information. You may not sell, lease or otherwise transfer use of or access to the API and data provided by TrustCloud to any third party.

Who will own what

Any of Your logos and designs are trademarks of Yours, and will not be used by TrustCloud without express written permission from You, other than for attribution. TrustCloud, the TrustCloud logo and the TrustCloud design are trademarks or trade dress of TrustCloud, and may not be used by You or any third party without express written permission from TrustCloud, other than for attribution. All other trademarks not owned by TrustCloud that appear on our Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by TrustCloud. You agree that TrustCloud, or its suppliers, own all right, title and interest in the API, the TrustCards, any of the data provided to You by TrustCloud and any other technology or materials provided to You by TrustCloud as part of our Beta program.

How long this will last

TrustCloud will provide this API to you free of charge for a minimum period of six months, whereupon the Beta program may be extended by mutual consent, or our continued partnership will be subject to a commercial license by mutual agreement between You and TrustCloud.

What this will cost

There is no cost for You to use the API and access all data provided by TrustCloud during the TrustCloud Beta program. If You require a custom integration to incorporate Your data with data provided by TrustCloud, or ingredient branding in your Trust solution, a customization fee may apply and you may be required to enter into a commercial license by mutual agreement between You and TrustCloud.

Providing feedback

You agree to provide TrustCloud with feedback when reasonably requested by TrustCloud during the Beta program, to help us identify and evaluate errors or difficulties You discovered through Your use of the API and on our Site, as well as your overall thoughts and opinions about TrustCloud. TrustCloud will have all right, title and interest in and to any feedback provided by You, and any of Your suggested modifications, design changes, features and improvements, without the payment of any additional consideration, and TrustCloud will have the right to use, in any manner and for any purpose, any such information provided by You. You agree that all such feedback is the proprietary and confidential information of TrustCloud.


In connection with the TrustCloud Beta program, You may obtain information of a proprietary and confidential nature about TrustCloud technology or the TrustCloud business. You agree to keep such information in strict confidence and that You will not use or disclose any such information except as necessary for Your participation in our Beta program or as otherwise expressly authorized by TrustCloud in writing. The foregoing shall not apply with respect to any information that is or becomes part of the public domain through no fault or failure of Yours.

Disclaimer of warranties and limited liability

Your use of and access to the API is part of our Beta program, and our Beta products and services may not be error free. TrustCloud provides You with use of and access to the API “as is” and makes no warranties of any kind with respect to the API, any products or services provided or any data supplied thereby, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose or noninfringement. TrustCloud shall not be liable with respect to Your use of and access to the API and any data provided by TrustCloud under any contract, negligence, strict liability or other theory for loss or inaccuracy of data or for any direct, indirect, incidental or consequential damages.
